Wyoming: verified exception
W.S. 11-49-103(b), as enacted by the Wyoming Food Freedom Act: “Notwithstanding any other provisions of law, there shall be no licensure, permitting, certification, inspection, packaging or labeling required by any state governmental agency or any agency of any political subdivision of the state which pertains to the preparation, serving, use, consumption or storage of foods or food products under the Wyoming Food Freedom Act.”
The Act defines “homemade” food as “food that is prepared in a private home kitchen, that is not licensed, inspected or regulated”. A 2023 amendment extended the Act to eggs and dairy products.
What actually applies
- The constraint is the shape of the sale, not paperwork. Transactions run producer-direct to an “informed end consumer” — defined as someone who does not resell the product and who has been informed that it is not licensed, regulated or inspected.
- The producer has to tell the buyer the food is not certified, labelled, licensed, packaged, regulated or inspected.
- Meat is treated separately, and food sold under the Act cannot be used as an ingredient in a commercial food establishment.
